Competency Motion Filed for Man Charged in Deputy Death

The attorney representing Virjilio Aguilar-Mendez, filed a motion implying that her client may lack the competency required to stand trial. The accusations relate to an incident that resulted in the tragic death of a St. Johns County deputy. The motion suggests that the defendant’s mental state should be evaluated to determine if he is capable of understanding the nature of the charges against him and if he is able to assist in his own defense.

Virjilio Aguilar-Mendez was arrested and charged with resisting arrest with violence and felony murder, after a struggle between him and Sgt. Michael Kunovich caused the deputy to collapse and die.
